Lenders and RESPA

Important changes have been made to RESPA (Real Estate Settlement Procedures Act) to provide better protection to borrowers in Real Estate transactions. A key element is the Good Faith Estimate (GFE) which has to be provided by the lender. It’s a three page form designed to encourage you to shop for a mortgage loanĀ & settlement services so that you can determine which mortgage is best for you. We highly recommend that you obtain a copy of “Shopping for Your Home Loan” booklet prepared by the U.S. Department of Housing and Urban Development (HUD) As in all major transactions, always seek advice from experienced professionals in the field.

Title Insurance and RESPA

Title insurance protects you, the buyer, against defects and human error. In other words, you want to make sure that the seller really owns the property you are buying and that there are no problems in the title’s ownership and history. Title insurance companies will search the public records to make sure that you get clear ownership to your new home, and they will insure you against any claims and legal fees that might arise.
